Zam\u011bstnanci pak stoj\u00ed na pokraji platebn\u00ed neschopnosti a jejich osobn\u00ed dluhov\u00e1 spir\u00e1la se za\u010d\u00edn\u00e1 rozt\u00e1\u010det.<\/strong> <!--more--><\/p>\n<p><em>ilustra\u010dn\u00ed foto: murielle \/ stock.xchng<\/em><\/p>\n<p>V\u00a0takov\u00fdch p\u0159\u00edpadech je podle odborn\u00edk\u016f <span style=\"font-family: Arial,sans-serif;\"><b>nejlep\u0161\u00edm \u0159e\u0161en\u00edm okam\u017eit\u00e9 ukon\u010den\u00ed pracovn\u00edho pom\u011bru s\u00a0n\u00e1rokem na odstupn\u00e9.<\/b><\/span> <span style=\"font-family: Arial,sans-serif;\"><b>Dal\u0161\u00edm krokem je pr\u00e1vn\u00ed \u017ealoba o zaplacen\u00ed dlu\u017en\u00e9 mzdy, odstupn\u00e9ho a \u00farok\u016f z prodlen\u00ed.<\/b><\/span><span style=\"font-family: Arial,sans-serif;\"> Se st\u00ed\u017enost\u00ed se mohou po\u0161kozen\u00ed zam\u011bstnanci obr\u00e1tit tak\u00e9 na p\u0159\u00edslu\u0161n\u00fd \u00fa\u0159ad pr\u00e1ce nebo inspektor\u00e1t pr\u00e1ce.<\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\">Zam\u011bstnavatel m\u00e1 povinnost vyplatit zam\u011bstnanci mzdu ve sjednan\u00fd den v\u00a0m\u011bs\u00edci, stanoven\u00fd v pracovn\u00ed smlouv\u011b. <\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\">\u201e<\/span><\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\"><b>Mzda je splatn\u00e1 po vykon\u00e1n\u00ed pr\u00e1ce, nejpozd\u011bji v\u0161ak do konce n\u00e1sleduj\u00edc\u00edho kalend\u00e1\u0159n\u00edho m\u011bs\u00edce.<\/b><\/span><\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\"> Tedy mzda za prosinec 2014 je nejpozd\u011bji splatn\u00e1 31. ledna 2015. <\/span><\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\"><b>Nedojde-li k vyplacen\u00ed mzdy zam\u011bstnavatelem do 15 dn\u016f po tomto term\u00ednu splatnosti mzdy, doporu\u010duji zv\u00e1\u017eit, zda se jedn\u00e1 pouze o nahodil\u00fd probl\u00e9m, anebo zda nen\u00ed lep\u0161\u00ed okam\u017eit\u011b ukon\u010dit pracovn\u00ed pom\u011br, dle z\u00e1kon\u00edku pr\u00e1ce s n\u00e1rokem na odstupn\u00e9,\u201c <\/b><\/span><\/span><span style=\"font-family: Arial,sans-serif;\"><b>rad\u00ed David Bascheri, advok\u00e1t spolupracuj\u00edc\u00ed s\u00a0port\u00e1lem ePohled\u00e1vky.cz, <\/b><\/span><span style=\"font-family: Arial,sans-serif;\">kde mohou zam\u011bstnanci z\u00edskat posouzen\u00ed sv\u00e9ho konkr\u00e9tn\u00edho p\u0159\u00edpadu on-line a zdarma.<\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\"><b>1. KROK: OKAM\u017dIT\u00c9 UKON\u010cEN\u00cd PRACOVN\u00cdHO POM\u011aRU <\/b><\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\">K okam\u017eit\u00e9mu ukon\u010den\u00ed pracovn\u00edho pom\u011bru pro nezaplacen\u00ed mzdy nalezne odvahu m\u00e1lokter\u00fd zam\u011bstnanec, ale vych\u00e1z\u00ed skute\u010dn\u011b nejl\u00e9pe. <\/span><span style=\"font-family: Arial,sans-serif;\"><b>Je s\u00a0n\u00edm toti\u017e spojeno odstupn\u00e9, podle \u00a7 56 z\u00e1kon\u00edku pr\u00e1ce<\/b><\/span> <span style=\"font-family: Arial,sans-serif;\"><b>ve v\u00fd\u0161i pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku za dobu, kter\u00e1 odpov\u00edd\u00e1 d\u00e9lce v\u00fdpov\u011bdn\u00ed lh\u016fty sjednan\u00e9 v\u00a0pracovn\u00ed smlouv\u011b. <\/b><\/span><span style=\"font-family: Arial,sans-serif;\">V\u00a0p\u0159\u00edpad\u011b, \u017ee nen\u00ed v\u00fdpov\u011bdn\u00ed doba v\u00a0pracovn\u00ed smlouv\u011b stanovena, n\u00e1le\u017e\u00ed zam\u011bstnanci <\/span><span style=\"font-family: Arial,sans-serif;\"><b>\u010d\u00e1stka odpov\u00eddaj\u00edc\u00ed dv\u011bma m\u011bs\u00ed\u010dn\u00edm mzd\u00e1m<\/b><\/span><span style=\"font-family: Arial,sans-serif;\">.<\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\">Okam\u017eit\u011b zru\u0161it pracovn\u00ed pom\u011br m\u016f\u017ee ka\u017ed\u00fd zam\u011bstnanec, kter\u00fd nedostal mzdu ani 15. den po z\u00e1konn\u00e9m term\u00ednu splatnosti mzdy. <\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\">\u201ePodle z\u00e1kon\u00edku pr\u00e1ce je ale tento n\u00e1rok na okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru tak\u00e9 \u010dasov\u011b omezen, zam\u011bstnanec tak mus\u00ed u\u010dinit do dvou m\u011bs\u00edc\u016f ode dne, kdy se o d\u016fvodu k okam\u017eit\u00e9mu zru\u0161en\u00ed pracovn\u00edho pom\u011bru dov\u011bd\u011bl, a nejpozd\u011bji do jednoho roku ode dne, kdy tento d\u016fvod vznikl. Proto se nevyplat\u00ed dlouho ot\u00e1let. D\u00e1le je t\u0159eba upozornit na skute\u010dnost, \u017ee <\/span><\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\"><b>z\u00a0d\u016fvodu neuhrazen\u00ed mzdy m\u016f\u017ee okam\u017eit\u011b pracovn\u00ed pom\u011br ukon\u010dit i zam\u011bstnanec ve zku\u0161ebn\u00ed dob\u011b. I takov\u00fd zam\u011bstnanec m\u00e1 n\u00e1sledn\u011b n\u00e1rok na odstupn\u00e9,\u201c<\/b><\/span><\/span><span style=\"font-family: Arial,sans-serif;\"><b> dodal David Bascheri.<\/b><\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\"><b>2. KROK: P\u00cdSEMN\u00c1 V\u00ddZVA ZAM\u011aSTNAVATELI<\/b><\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\">P\u0159\u00edpady nezaplacen\u00fdch mezd, kter\u00e9 advok\u00e1ti z\u00a0port\u00e1lu ePohled\u00e1vky.cz denn\u011b \u0159e\u0161\u00ed on-line, zahrnuj\u00ed \u010d\u00e1stky od 700 do 240\u00a0000 korun. <\/span><span style=\"font-family: Arial,sans-serif;\"><b>Pr\u016fm\u011brn\u011b dlu\u017e\u00ed zam\u011bstnavatel jednomu zam\u011bstnanci 45\u00a0000 korun. <\/b><\/span><span style=\"font-family: Arial,sans-serif;\">Nejhor\u0161\u00ed situace panuje tradi\u010dn\u011b v\u00a0Praze, kter\u00e1 zauj\u00edm\u00e1 t\u00e9m\u011b\u0159 39 procent problematick\u00fdch pohled\u00e1vek v\u00a0oblasti nezaplacen\u00fdch mezd, naopak nejlep\u0161\u00ed platebn\u00ed mor\u00e1lku v\u016f\u010di zam\u011bstnanc\u016fm vykazuj\u00ed kraje Plze\u0148sk\u00fd, Karlovarsk\u00fd a Vyso\u010dina.<\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"color: #1f497d;\">\u201e<\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\">\u010casto \u0159e\u0161\u00edme p\u0159\u00edpady propu\u0161t\u011bn\u00ed ve zku\u0161ebn\u00ed dob\u011b bez n\u00e1roku na honor\u00e1\u0159. Probl\u00e9my s\u00a0nevyplacen\u00edm mzdy se ale t\u00fdkaj\u00ed i zaveden\u00fdch zam\u011bstnanc\u016f, kte\u0159\u00ed nev\u011bd\u00ed, jak se br\u00e1nit, a pracuj\u00ed zadarmo i n\u011bkolik m\u011bs\u00edc\u016f,\u201c<\/span><\/span><span style=\"font-family: Arial,sans-serif;\"> uvedl Tom\u00e1\u0161 Med\u0159ick\u00fd, \u0159editel port\u00e1lu ePohled\u00e1vky.cz. <\/span><span style=\"font-family: Arial,sans-serif;\"><b>N\u00e1rok na mzdu se proml\u010d\u00ed do t\u0159\u00ed let ode dne jej\u00ed splatnosti. Pokud je v\u0161ak uzn\u00e1n p\u00edsemn\u011b zam\u011bstnavatelem, proml\u010dec\u00ed lh\u016fta \u010din\u00ed 10 let.<\/b><\/span> <span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\">\u201eProto po okam\u017eit\u00e9m zru\u0161en\u00ed pracovn\u00edho pom\u011bru doporu\u010dujeme zaslat zam\u011bstnavateli p\u00edsemnou v\u00fdzvu k\u00a0uhrazen\u00ed dlu\u017en\u00e9 mzdy a stanovit v\u00a0n\u00ed splniteln\u00fd term\u00edn. Pokud bude zam\u011bstnavatel ignorovat i tuto v\u00fdzvu, \u0159e\u0161en\u00edm je soudn\u00ed \u017ealoba,\u201c<\/span><\/span><span style=\"font-family: Arial,sans-serif;\"> dodal Tom\u00e1\u0161 Med\u0159ick\u00fd.<\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\"><b>3. KROK: \u017dALOBA O ZAPLACEN\u00cd DLU\u017dN\u00c9 MZDY<\/b><\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\">\u017dalobu o zaplacen\u00ed dlu\u017en\u00e9 mzdy m\u016f\u017ee podat ka\u017ed\u00fd jednotliv\u00fd zam\u011bstnanec, anebo v\u00a0p\u0159\u00edpad\u011b v\u00edce po\u0161kozen\u00fdch pracovn\u00edk\u016f lze uplatnit \u017ealobu hromadnou. <\/span><span style=\"font-family: Arial,sans-serif;\"><b>U soudu jsou pak krom\u011b mzdy a odstupn\u00e9ho vymahateln\u00e9 tak\u00e9 z\u00e1konn\u00e9 \u00faroky z\u00a0prodlen\u00ed, a to ode dne splatnosti mzdy do zaplacen\u00ed, aktu\u00e1ln\u011b ve v\u00fd\u0161i osmi procent z\u00a0dlu\u017en\u00e9 \u010d\u00e1stky ro\u010dn\u011b. <\/b><\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\">\u201ePokud se po bezplatn\u00e9 re\u0161er\u0161i konkr\u00e9tn\u00edho p\u0159\u00edpadu na port\u00e1lu ePohled\u00e1vky.cz rozhodne zadavatel d\u00e1l pokra\u010dovat v\u00a0on-line spolupr\u00e1ci s\u00a0advok\u00e1ty, bude jeho zam\u011bstnavateli zasl\u00e1na <\/span><\/span><span style=\"color: #1f497d;\"><span style=\"font-family: Arial,sans-serif;\"><b>p\u0159ed\u017ealobn\u00ed upom\u00ednka, na kterou reaguje 37 procent dlu\u017en\u00edk\u016f, v\u00a0soudn\u00edm \u0159\u00edzen\u00ed pak d\u00edky p\u0159ede\u0161l\u00e9mu kladn\u00e9mu posouzen\u00ed n\u00e1roku usp\u011bje v\u011bt\u0161ina v\u011b\u0159itel\u016f,\u201c<\/b><\/span><\/span><span style=\"font-family: Arial,sans-serif;\"><b> popsal Tom\u00e1\u0161 Med\u0159ick\u00fd.<\/b><\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\">Pokud je zam\u011bstnavatel v\u00a0insolvenci, m\u016f\u017ee zam\u011bstnanci poskytnout finan\u010dn\u00ed n\u00e1hradu tak\u00e9 krajsk\u00fd \u00fa\u0159ad pr\u00e1ce, maxim\u00e1ln\u011b v\u0161ak do v\u00fd\u0161e t\u0159\u00edm\u011bs\u00ed\u010dn\u00edho platu a za spln\u011bn\u00ed podm\u00ednek podle z\u00e1kona o ochran\u011b zam\u011bstnanc\u016f p\u0159ed platebn\u00ed neschopnost\u00ed. Na nez\u00e1konn\u00e9 chov\u00e1n\u00ed firmy lze tak\u00e9 upozornit oblastn\u00ed inspektor\u00e1t pr\u00e1ce, kter\u00fd takov\u00e9mu zam\u011bstnavateli ulo\u017e\u00ed pokutu a\u017e do v\u00fd\u0161e dvou milion\u016f korun.<\/span><\/p>\n<p class=\"western\" align=\"justify\">\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\"><b>O port\u00e1lu ePohled\u00e1vky.cz<\/b><\/span><\/p>\n<p class=\"western\" align=\"justify\"><span style=\"font-family: Arial,sans-serif;\"><span style=\"font-size: small;\">Webov\u00fd port\u00e1l ePohled\u00e1vky.cz p\u0159in\u00e1\u0161\u00ed \u0159e\u0161en\u00ed spr\u00e1vy problematick\u00fdch pohled\u00e1vek.
