Ne v\u0161ichni se ale dom\u016f vr\u00e1t\u00ed spokojen\u00ed. \u0160pinav\u00fd pokoj, jin\u00fd ne\u017e sl\u00edben\u00fd hotel nebo \u0161patn\u00e1 strava \u2013 to jsou v\u011bci, kter\u00e9 \u010ce\u0161i po n\u00e1vratu z\u00a0dovolen\u00e9 nej\u010dast\u011bji reklamuj\u00ed.  <\/strong><!--more--><\/p>\n<p>ilustra\u010dn\u00ed foto: qnr Flickr.com<\/p>\n<p>K\u00a0nej\u010dast\u011bji reklamovan\u00fdm destinac\u00edm pat\u0159\u00ed \u0158ecko, Turecko a Tunisko. Pr\u00e1v\u011b \u0158ecko ale st\u00e1le pat\u0159\u00ed k\u00a0nejnav\u0161t\u011bvovan\u011bj\u0161\u00edm zem\u00edm. Tuzemskou dovolenou pl\u00e1nuje 41 procent lid\u00ed, ani ta ale nen\u00ed s\u00e1zkou na jistotu. Co d\u011blat, kdy\u017e se vysn\u011bn\u00e1 dovolen\u00e1 prom\u011bn\u00ed v\u00a0no\u010dn\u00ed m\u016fru? <\/p>\n<p>\u201eZ\u00e1kladem je dostate\u010dn\u00e9 prostudov\u00e1n\u00ed smlouvy v\u010detn\u011b v\u0161ech smluvn\u00edch podm\u00ednek. Smlouva o z\u00e1jezdu by m\u011bla obsahovat v\u0161echny podstatn\u00e9 informace t\u00fdkaj\u00edc\u00ed se z\u00e1jezdu, tedy to, co od z\u00e1jezdu bude z\u00e1kazn\u00edk o\u010dek\u00e1vat. Nen\u00ed ur\u010dit\u011b od v\u011bci zjistit si od cestovn\u00ed kancel\u00e1\u0159e ve\u0161ker\u00e9 podrobnosti t\u00fdkaj\u00edc\u00ed se z\u00e1jezdu, nap\u0159\u00edklad zda je hotelov\u00fd pokoj s v\u00fdhledem na mo\u0159e nebo informace o stravov\u00e1n\u00ed, a n\u00e1sledn\u011b db\u00e1t na to, aby tyto po\u017eadavky smlouva o z\u00e1jezdu obsahovala. V p\u0159\u00edpad\u011b, \u017ee by tomu tak nebylo, bude pro z\u00e1kazn\u00edka velice obt\u00ed\u017en\u00e9 dovol\u00e1vat se spln\u011bn\u00ed po\u017eadavk\u016f, p\u0159\u00edpadn\u011b z\u00e1jezd n\u00e1sledn\u011b reklamovat,\u201c upozornil Ji\u0159\u00ed Hartmann z\u00a0advok\u00e1tn\u00ed kancel\u00e1\u0159e Hartmann, Jel\u00ednek, Fr\u00e1\u0148a a partne\u0159i. <\/p>\n<p>Pokud z\u00e1kazn\u00edk zjist\u00ed hned po p\u0159\u00edjezdu, \u017ee nen\u00ed n\u011bco v\u00a0po\u0159\u00e1dku, nevypl\u00e1c\u00ed se se st\u00ed\u017enostmi ot\u00e1let. Situaci je vhodn\u00e9 \u0159e\u0161it ihned. \u201eV prvn\u00edm okam\u017eiku by se m\u011bl \u010dlov\u011bk obr\u00e1tit na deleg\u00e1ta cestovn\u00ed kancel\u00e1\u0159e a trvat na zjedn\u00e1n\u00ed n\u00e1pravy. V mnoha p\u0159\u00edpadech je mo\u017en\u00e9 situaci vy\u0159e\u0161it na m\u00edst\u011b. Pokud navzdory st\u00ed\u017enostem nedojde k odstran\u011bn\u00ed vad, m\u016f\u017ee klient cestovn\u00ed kancel\u00e1\u0159e n\u00e1pravu zjednat s\u00e1m, nap\u0159\u00edklad p\u0159est\u011bhov\u00e1n\u00edm se na vlastn\u00ed n\u00e1klady do jin\u00e9ho hotelu stejn\u00e9 \u00farovn\u011b nebo zaji\u0161t\u011bn\u00edm vlastn\u00edho stravov\u00e1n\u00ed. N\u00e1sledn\u011b m\u016f\u017ee po cestovn\u00ed kancel\u00e1\u0159i \u017e\u00e1dat n\u00e1hradu vynalo\u017een\u00fdch n\u00e1klad\u016f. V p\u0159\u00edpad\u011b pozd\u011bj\u0161\u00ed reklamace je t\u0159eba p\u00edsemnou reklamaci doplnit reklama\u010dn\u00edm protokolem z m\u00edsta pobytu podepsan\u00fdm deleg\u00e1tem cestovn\u00ed kancel\u00e1\u0159e, cestovn\u00ed smlouvou a d\u016fkazy, kter\u00fdmi bude mo\u017en\u00e9 vady z\u00e1jezdu prok\u00e1zat,\u201c popsal Ji\u0159\u00ed Hartmann. <\/p>\n<p>Po n\u00e1vratu z\u00a0dovolen\u00e9 a\u017e 24 procent \u010cech\u016f reklamuje jin\u00fd ne\u017e sl\u00edben\u00fd hotel. Pen\u00edze zp\u011bt lze ale po\u017eadovat i za nekvalitn\u00ed stravu. Na tu si st\u011b\u017euje kolem 15 procent \u010cech\u016f, reklamaci mohou uplatnit i kv\u016fli jednotv\u00e1rnosti pokrm\u016f. \u201eZ\u00e1kazn\u00edk m\u016f\u017ee reklamovat i poskytovan\u00e9 stravov\u00e1n\u00ed nap\u0159\u00edklad z d\u016fvodu nedostate\u010dn\u00e9 hygieny, zdravotn\u011b z\u00e1vadn\u00fdch potravin, nebo dokonce z d\u016fvodu, \u017ee je strava jednotv\u00e1rn\u00e1. Aby mohl z\u00e1kazn\u00edk po n\u00e1vratu z dovolen\u00e9 \u00fasp\u011b\u0161n\u011b reklamovat vady z\u00e1jezdu, je t\u0159eba opat\u0159it si dostate\u010dn\u00e9 d\u016fkazy, kter\u00fdmi bude mo\u017en\u00e9 vady z\u00e1jezdu prok\u00e1zat. V prvn\u00ed \u0159ad\u011b je vhodn\u00e9 sepsat s deleg\u00e1tem cestovn\u00ed kancel\u00e1\u0159e protokol o vad\u00e1ch z\u00e1jezdu. D\u00e1le je vhodn\u00e9 opat\u0159it si fotografie v\u0161ech nedostatk\u016f, kter\u00e9 hodl\u00e1 z\u00e1kazn\u00edk reklamovat. Pokud jde o vady, kter\u00e9 nelze zdokumentovat, nap\u0159\u00edklad hluk nebo z\u00e1pach, m\u016f\u017ee se z\u00e1kazn\u00edk obr\u00e1tit na ostatn\u00ed z\u00e1kazn\u00edky cestovn\u00ed kancel\u00e1\u0159e, kte\u0159\u00ed mu tyto skute\u010dnosti dosv\u011bd\u010d\u00ed. Z\u00e1jezd je mo\u017en\u00e9 reklamovat nejpozd\u011bji do jednoho m\u011bs\u00edce od jeho skon\u010den\u00ed,\u201c upozornil Ji\u0159\u00ed Hartmann.<\/p>\n<p>Cestovn\u00ed kancel\u00e1\u0159e zpravidla reklamace \u0159e\u0161\u00ed slevou. Pokud chce z\u00e1kazn\u00edk pen\u00edze zp\u011bt, ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f doch\u00e1z\u00ed na soudn\u00ed \u0159\u00edzen\u00ed. \u201eReklamace mus\u00ed b\u00fdt cestovn\u00ed kancel\u00e1\u0159\u00ed vy\u0159\u00edzena bezodkladn\u011b, nejpozd\u011bji v\u0161ak do 30 dn\u016f. To plat\u00ed i v\u00a0p\u0159\u00edpad\u011b, pokud nebyla uplatn\u011bna p\u0159\u00edmo u cestovn\u00ed kancel\u00e1\u0159e, kter\u00e1 z\u00e1jezd po\u0159\u00e1dala, ale jen u cestovn\u00ed agentury organizuj\u00edc\u00ed z\u00e1jezd. V p\u0159\u00edpad\u011b, \u017ee cestovn\u00ed kancel\u00e1\u0159 nevy\u0159\u00edd\u00ed reklamaci v z\u00e1konn\u00e9 lh\u016ft\u011b 30 dn\u016f, a nen\u00ed ani pravd\u011bpodobn\u00e9, \u017ee by reklamaci vy\u0159\u00eddila, nezb\u00fdv\u00e1 z\u00e1kazn\u00edkovi cestovn\u00ed kancel\u00e1\u0159e ne\u017e se obr\u00e1tit se sv\u00fdm n\u00e1rokem na v\u011bcn\u011b a m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00fd soud,\u201c popsal Ji\u0159\u00ed Hartmann.<\/p>\n<p>Vedle nedodr\u017een\u00ed podm\u00ednek ze strany cestovn\u00ed kancel\u00e1\u0159e um\u00ed dovolenou tak\u00e9 zkomplikovat nap\u0159\u00edklad necht\u011bn\u011b rozbit\u00e9 okno hotelov\u00e9ho pokoje. To m\u016f\u017ee po\u0159\u00e1dn\u011b nabourat rozpo\u010det. Proto se p\u0159ed odjezdem vyplat\u00ed sjednat si cestovn\u00ed poji\u0161t\u011bn\u00ed. Bez n\u011bj vyr\u00e1\u017e\u00ed na dovolenou u\u017e jen 14 procent \u010cech\u016f. K nejv\u011bt\u0161\u00edm po\u010dt\u016fm pojistn\u00fdch ud\u00e1lost\u00ed doch\u00e1z\u00ed v Egypt\u011b, \u0158ecku a Turecku. \u201eKa\u017ed\u00e9 kvalitn\u00ed cestovn\u00ed poji\u0161t\u011bn\u00ed ji\u017e zpravidla obsahuje poji\u0161t\u011bn\u00ed za \u0161kodu na majetku a zdrav\u00ed druh\u00fdch. V p\u0159\u00edpad\u011b, \u017ee na dovolen\u00e9 zp\u016fsob\u00ed nap\u0159\u00edklad d\u00edt\u011b \u0161kodu n\u011bkomu jin\u00e9mu, lze jedin\u011b doporu\u010dit v\u017edy ud\u00e1lost d\u016fkladn\u011b zdokumentovat, aby se p\u0159ede\u0161lo nep\u0159im\u011b\u0159en\u00fdm n\u00e1rok\u016fm po\u0161kozen\u00e9ho.
