Podobn\u00e9 z\u00e1sadn\u00ed zm\u011bny \u010dekaj\u00ed zam\u011bstnavatele zam\u011bstn\u00e1vaj\u00edc\u00ed v\u00edce jak 50 % zam\u011bstnanc\u016f se zdravotn\u00edm posti\u017een\u00edm (OZP) i letos.<\/strong><\/div>\n<p><!--more--><\/p>\n<div class=\"page\" data-page-number=\"1\"><\/div>\n<p>\u00da\u0159ad pr\u00e1ce krajsk\u00e1 pobo\u010dka pro hl.m. Prahu neposkytl pra\u017esk\u00e9 firm\u011b EUC Premium Assistance s.r.o. p\u0159\u00edsp\u011bvek na podporu zam\u011bstn\u00e1v\u00e1n\u00ed osob se zdravotn\u00edm posti\u017een\u00edm na chr\u00e1n\u011bn\u00e9m pracovn\u00edm m\u00edst\u011b za 3. \u010dtvrtlet\u00ed roku 2012 v celkov\u00e9 v\u00fd\u0161i 254 201,- K\u010d a 60 000,- K\u010d podle \u00a7 78 odst. 3 z\u00e1kona o zam\u011bstnanosti.<\/p>\n<div>Odvol\u00e1n\u00ed firmy Ministerstvo pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed (MPSV) zam\u00edtlo.<\/div>\n<div>Firma se proto obr\u00e1tila na M\u011bstsk\u00fd soud v Praze, ten v\u0161ak \u017ealobu firmy proti rozhodnut\u00ed MPSV o odvol\u00e1n\u00ed zam\u00edtl.<\/div>\n<div><\/div>\n<div><strong>Firma ve sv\u00e9 \u017ealob\u011b popsala okolnosti,<\/strong> za nich\u017e pod\u00e1vala \u017e\u00e1dost o vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst, jako\u017e i postup \u00fa\u0159adu pr\u00e1ce, kter\u00fd dle st\u011b\u017eovatele zap\u0159\u00ed\u010dinil, \u017ee byla \u017e\u00e1dost pod\u00e1na a\u017e na konci \u010dervna roku 2012, p\u0159i\u010dem\u017e dohoda o vymezen\u00ed CHPM byla uzav\u0159ena v\u00edce ne\u017e po t\u0159ech m\u011bs\u00edc\u00edch.<\/div>\n<div><\/div>\n<div><\/div>\n<div><strong>Firma uvedla, \u017ee s \u00fa\u0159adem pr\u00e1ce spolupracovala ji\u017e od druh\u00e9ho<\/strong> \u010dtvrtlet\u00ed roku 2010 a\u017e do druh\u00e9ho \u010dtvrtlet\u00ed roku 2012, kdy j\u00ed byl poskytov\u00e1n p\u0159\u00edsp\u011bvek na podporu zam\u011bstn\u00e1v\u00e1n\u00ed osob se zdravotn\u00edm posti\u017een\u00edm dle tehdy platn\u00e9ho \u00a7 78 z\u00e1kona o zam\u011bstnanosti.<\/div>\n<div><\/div>\n<div><strong>Po novele bylo v 1. \u010dtvrtlet\u00ed roku 2012 firm\u011b sd\u011bleno, \u017ee j\u00ed nemohou<\/strong> podat informace, proto\u017ee nem\u00e1 \u00fa\u0159ad pr\u00e1ce metodiku od MPSV, stejn\u011b jako formul\u00e1\u0159e pro \u017e\u00e1dost a dohodu o vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst. V dubnu bylo firm\u011b sd\u011bleno, \u017ee metodika je ji\u017e vytvo\u0159ena, ale \u00fa\u0159ad pr\u00e1ce nep\u0159ijme \u017e\u00e1dost bez vyj\u00e1d\u0159en\u00ed hygienika, pracovn\u00edk hygienick\u00e9 stanice v\u0161ak firm\u011b sd\u011blil, \u017ee \u017e\u00e1dn\u00e9 takov\u00e9 potvrzen\u00ed nen\u00ed nutn\u00e9 a hygienick\u00e1 stanice jej nevyd\u00e1v\u00e1. Formul\u00e1\u0159e na internetu se objevily a\u017e koncem kv\u011btna, kontaktovat pracovnici \u00fa\u0159adu pr\u00e1ce se firm\u011b nepoda\u0159ilo a a\u017e od jin\u00fdch zam\u011bstnavatel\u016f \u0159e\u0161\u00edc\u00edch t\u00fd\u017e probl\u00e9m (\u0159e\u0161en\u00fd i Komorou zam\u011bstnavatel\u016f zdravotn\u011b posti\u017een\u00fdch) se dozv\u011bd\u011bl, \u017ee ji\u017e \u00fa\u0159ad pr\u00e1ce od po\u017eadavku na p\u0159edlo\u017een\u00ed potvrzen\u00ed hygienika upustil . A\u017e dva a p\u016fl m\u011bs\u00edce po pod\u00e1n\u00ed \u017e\u00e1dosti dostal 13. 9. 2012 e-mail s v\u00fdzvou k p\u0159edlo\u017een\u00ed doklad\u016f, kter\u00e9 (mimo n\u00e1jemn\u00ed smlouvy) m\u011bl \u00fa\u0159ad pr\u00e1ce k dispozici, po urgenc\u00edch prob\u011bhlo m\u00edstn\u00ed \u0161et\u0159en\u00ed 24. 9. 2012; ve\u0161ker\u00e9 podm\u00ednky pro vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst byly podle protokolu z tohoto \u0161et\u0159en\u00ed spln\u011bny ji\u017e k datu pod\u00e1n\u00ed \u017e\u00e1dosti.<\/div>\n<div><\/div>\n<div><strong>MPSV p\u0159itom argumentoval t\u00edm, \u017ee si firma m\u011bla o vymezen\u00ed<\/strong> chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst po\u017e\u00e1dat d\u0159\u00edve. Na to firma reagovala t\u00edm, \u017ee nem\u00e1 \u017e\u00e1dnou mo\u017enost p\u0159edv\u00eddat ani ovlivnit d\u00e9lku rozhodov\u00e1n\u00ed \u00fa\u0159adu pr\u00e1ce a \u017ee v\u010das podan\u00e1 \u017e\u00e1dost je ta, kter\u00e1 byla pod\u00e1na v pr\u016fb\u011bhu 1. a 2. \u010dtvrtlet\u00ed roku 2012, a co se d\u011bje potom, nem\u016f\u017ee b\u00fdt p\u0159i\u010d\u00edt\u00e1no k t\u00ed\u017ei \u017eadatele.<\/div>\n<div><\/div>\n<div><strong>Firma tvrdila, \u017ee u\u010dinila v\u0161e, co bylo mo\u017en\u00e9, aktivn\u011b jednala s \u00fa\u0159adem<\/strong> pr\u00e1ce a usilovala o vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst.<\/div>\n<div>\u00da\u0159ad pr\u00e1ce ale neposkytoval informace a brzdil p\u0159\u00edpravu \u017e\u00e1dosti. Nelze tud\u00ed\u017e kl\u00e1st \u017eadateli za vinu, \u017ee byla \u017e\u00e1dost pod\u00e1na a\u017e v \u010dervnu 2012.<\/div>\n<div><\/div>\n<div><strong>Za jedin\u00e9 rozumn\u00e9 \u0159e\u0161en\u00ed k p\u0159edejit\u00ed absurdn\u00edm n\u00e1sledk\u016fm, kter\u00e9<\/strong> \u017eadatel popsal, je pova\u017eovat za rozhodnou skute\u010dnost dobu pod\u00e1n\u00ed \u017e\u00e1dosti o vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst. Pro p\u0159izn\u00e1n\u00ed p\u0159\u00edsp\u011bvku mus\u00ed b\u00fdt podle firmy, tedy \u017eadatele, rozhodn\u00e9, zda byla \u017e\u00e1dost pod\u00e1na v\u010das, nikoliv, kdy o n\u00ed \u00fa\u0159ad pr\u00e1ce rozhodl, resp. kdy byla uzav\u0159ena dohoda.<\/div>\n<div><\/div>\n<p><strong>C\u00edlem novely<\/strong> jist\u011b podle firmy nebylo vytvo\u0159en\u00ed mezery v poskytov\u00e1n\u00ed p\u0159\u00edsp\u011bvku v d\u016fsledku nov\u00fdch administrativn\u00edch po\u017eadavk\u016f, ale naopak plynul\u00e9 pokra\u010dov\u00e1n\u00ed v obdob\u00ed po \u00fa\u010dinnosti novely proveden\u00e9 z\u00e1konem \u010d. 367\/2011 Sb.<\/p>\n<div>I p\u0159i p\u0159ijet\u00ed z\u00e1v\u011bru, \u017ee <strong>pro p\u0159izn\u00e1n\u00ed p\u0159\u00edsp\u011bvku je rozhodn\u00e9 uzav\u0159en\u00ed<\/strong> dohody, m\u011bla firma za to, \u017ee p\u0159\u00edsp\u011bvek j\u00ed m\u011bl b\u00fdt p\u0159izn\u00e1n ode dne, kdy k jej\u00edmu uzav\u0159en\u00ed m\u011blo doj\u00edt ve standardn\u00ed lh\u016ft\u011b pro vy\u0159\u00edzen\u00ed \u017e\u00e1dosti. Prodlen\u00ed \u00fa\u0159adu pr\u00e1ce nezap\u0159\u00ed\u010din\u011bn\u00e9 \u017eadatelem mu nem\u016f\u017ee b\u00fdt na \u00fajmu.<\/div>\n<div><\/div>\n<div><strong>Z\u00e1kon o zam\u011bstnanosti ani prov\u00e1d\u011bc\u00ed vyhl\u00e1\u0161ka \u017e\u00e1dnou lh\u016ftu neobsahuje<\/strong>, proto m\u011blo b\u00fdt podle firmy rozhodnuto v souladu se z\u00e1konem \u010d. 500\/2004 Sb., spr\u00e1vn\u00ed \u0159\u00e1d, bezodkladn\u011b. P\u0159esto\u017ee \u00fa\u0159ad pr\u00e1ce v p\u0159\u00edpad\u011b kladn\u00e9ho posouzen\u00ed \u017e\u00e1dosti \u017e\u00e1dn\u00e9 rozhodnut\u00ed nevyd\u00e1v\u00e1 a p\u0159\u00edmo uzav\u0159e dohodu, jednalo se podle m\u00edn\u011bn\u00ed firmy o rozhodov\u00e1n\u00ed ve spr\u00e1vn\u00edm \u0159\u00edzen\u00ed a proto nesouhlas\u00ed s \u00fa\u0159adem pr\u00e1ce, \u017ee se na vy\u0159\u00edzen\u00ed \u017e\u00e1dosti nevztahuj\u00ed lh\u016fty stanoven\u00e9 spr\u00e1vn\u00edm \u0159\u00e1dem.<\/div>\n<div><\/div>\n<div>Firma pouk\u00e1zala na z\u00e1sadu v\u00fdkonu ve\u0159ejn\u00e9 spr\u00e1vy jako slu\u017eby ve\u0159ejnosti. To za situace, kdy z\u00e1kon st\u011b\u017eovateli neumo\u017e\u0148uje br\u00e1nit se samostatn\u011b proti postupu \u00fa\u0159adu pr\u00e1ce p\u0159i vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst.<\/div>\n<p>Firma, kter\u00e1 byla aktivn\u00ed a s \u00fa\u0159adem pr\u00e1ce komunikovala, v t\u00e9 dob\u011b nav\u00edc je\u0161t\u011b <strong>netu\u0161ila, jak fat\u00e1ln\u00ed d\u016fsledky bude zpo\u017ed\u011bn\u00ed s uzav\u0159en\u00edm<\/strong> dohody m\u00edt.\u00a0 Spr\u00e1vn\u00ed org\u00e1n by podle firmy m\u011bl postupovat tak, aby \u00fa\u010dastn\u00edk\u016fm \u0159\u00edzen\u00ed nevznikla \u0161koda, p\u0159\u00edpadn\u011b zamezil jej\u00ed hrozb\u011b.<\/p>\n<div>Jestli\u017ee nespr\u00e1vn\u00fd byl postup v p\u0159edchoz\u00edm \u0159\u00edzen\u00ed, ale spr\u00e1vn\u00ed org\u00e1n m\u016f\u017ee je\u0161t\u011b vzniku \u0161kody zabr\u00e1nit, nem\u016f\u017ee b\u00fdt ne\u010dinn\u00fd.<\/div>\n<div><\/div>\n<div><strong>Postup \u00fa\u0159adu pr\u00e1ce omezuj\u00edc\u00ed poskytov\u00e1n\u00ed p\u0159\u00edsp\u011bvk\u016f ohro\u017euje<\/strong> i zdravotn\u011b posti\u017een\u00e9 zam\u011bstnance, na jejich\u017e ochran\u011b je zalo\u017een cel\u00fd syst\u00e9m podpory. Pro zam\u011bstnavatele, kter\u00fd zam\u011bstn\u00e1v\u00e1 v\u00edce ne\u017e 50% osob se zdravotn\u00edm posti\u017een\u00edm, je p\u0159\u00edsp\u011bvek na mzdy a vytvo\u0159en\u00ed pracovn\u00edch podm\u00ednek nezbytn\u00fd, a mus\u00ed b\u00fdt proto poskytov\u00e1n za p\u0159edv\u00eddateln\u00fdch podm\u00ednek, nikoliv v z\u00e1vislosti na rychlosti \u00fa\u0159adu pr\u00e1ce. V opa\u010dn\u00e9m p\u0159\u00edpad\u011b se zam\u011bstnavatel dost\u00e1v\u00e1 do probl\u00e9m\u016f, kter\u00e9 mohou v\u00e9st k ukon\u010den\u00ed jeho \u010dinnosti nebo ukon\u010den\u00ed zam\u011bstn\u00e1v\u00e1n\u00ed zdravotn\u011b posti\u017een\u00fdch osob.<\/div>\n<p><strong>MPSV tvrdil<\/strong>, \u017ee pro posouzen\u00ed n\u00e1roku na poskytnut\u00ed p\u0159\u00edsp\u011bvku jsou tyto okolnosti nerozhodn\u00e9. Krom\u011b toho \u00fadajn\u00e9 pochyben\u00ed \u00fa\u0159adu pr\u00e1ce st\u011b\u017eovatel nijak nedokl\u00e1d\u00e1 a z\u016fstalo v rovin\u011b tvrzen\u00ed. \u017dalovan\u00fd podotkl,\u00a0 \u017ee na uzav\u0159en\u00ed dohody nen\u00ed pr\u00e1vn\u00ed n\u00e1rok, proto nelze ani dovozovat, \u017ee o \u017e\u00e1dosti mus\u00ed b\u00fdt rozhodnuto v ur\u010dit\u00e9m \u010dase.<\/p>\n<p><strong>Soud se ztoto\u017enil s MPSV<\/strong>, \u017ee zn\u011bn\u00ed z\u00e1kona je jednozna\u010dn\u00e9 a neumo\u017e\u0148uje v\u00edce mo\u017en\u00fdch v\u00fdklad\u016f. Podle n\u011bj se pracovn\u00ed m\u00edsto obsazen\u00e9 osobou se zdravotn\u00edm posti\u017een\u00edm st\u00e1v\u00e1 chr\u00e1n\u011bn\u00fdm pracovn\u00edm m\u00edstem a\u017e vymezen\u00edm v p\u00edsemn\u00e9 dohod\u011b mezi zam\u011bstnavatelem a \u00da\u0159adem pr\u00e1ce (\u00a7 75 odst. 1 z\u00e1kona o zam\u011bstnanosti).<\/p>\n<div>Pro vznik n\u00e1roku na p\u0159\u00edsp\u011bvek je pak <strong>rozhodn\u00e9 uzav\u0159en\u00ed dohody<\/strong> o vymezen\u00ed chr\u00e1n\u011bn\u00e9ho pracovn\u00edho m\u00edsta. Vzhledem k tomu, \u017ee tato dohoda nebyla uzav\u0159ena do 30. 6. 2012 v\u010detn\u011b, ale a\u017e 27. 9. 2012, nevznikl n\u00e1rok na zv\u00fd\u0161en\u00ed p\u0159\u00edsp\u011bvku ji\u017e za 3. \u010dtvrtlet\u00ed, ale vznikl a\u017e od n\u00e1sleduj\u00edc\u00edho kalend\u00e1\u0159n\u00edho \u010dtvrtlet\u00ed(tzn. 4. \u010dtvrtlet\u00ed 2012).<\/div>\n<div><\/div>\n<div>\n<div><strong>Nicm\u00e9n\u011b soud dal firm\u011b nad\u011bji se domoci nep\u0159iznan\u00e9ho p\u0159\u00edsp\u011bvku<\/strong>, kdy\u017e v rozsudku uvedl: &#8222;Domn\u00edv\u00e1-li se st\u011b\u017eovatel, \u017ee mu nespr\u00e1vn\u00fdm \u00fa\u0159edn\u00edm postupem vznikla \u0161koda, m\u016f\u017ee se se sv\u00fdm n\u00e1rokem obr\u00e1tit na p\u0159\u00edslu\u0161n\u00e9 org\u00e1ny postupem podle z\u00e1kona \u010d. 82\/1998 Sb., o odpov\u011bdnosti za \u0161kodu zp\u016fsobenou p\u0159i v\u00fdkonu ve\u0159ejn\u00e9 moci rozhodnut\u00edm nebo nespr\u00e1vn\u00fdm \u00fa\u0159edn\u00edm postupem a o zm\u011bn\u011b z\u00e1kona \u010cesk\u00e9 n\u00e1rodn\u00ed rady \u010d. 358\/1992 Sb., o not\u00e1\u0159\u00edch a jejich \u010dinnosti (not\u00e1\u0159sk\u00fd \u0159\u00e1d).<\/div>\n<\/div>\n<div>\n<div><\/div>\n<div><strong>Po 1. 1. 2012 z\u00e1kon o zam\u011bstnanosti stanovil<\/strong> v \u00a7 75 odst. 1<\/div>\n<div>mo\u017enost poskytnut\u00ed p\u0159\u00edsp\u011bvku na z\u00e1klad\u011b dohody s \u00fa\u0159adem pr\u00e1ce<\/div>\n<div>a) o z\u0159\u00edzen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst a o p\u0159\u00edsp\u011bvku na jejich z\u0159\u00edzen\u00ed<\/div>\n<div>(\u00a7 75 odst. 8) , b) o vymezen\u00ed chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst, tzn. \u201euzn\u00e1n\u00ed\u201c pracovn\u00edho m\u00edsta ji\u017e obsazen\u00e9ho osobou se zdravotn\u00edm posti\u017een\u00edm (\u00a7 75 odst. 12),<\/div>\n<div>c) o p\u0159\u00edsp\u011bvku na \u010d\u00e1ste\u010dnou \u00fahradu provozn\u00edch n\u00e1klad\u016f chr\u00e1n\u011bn\u00e9ho pracovn\u00edho m\u00edsta z\u0159\u00edzen\u00e9ho nebo vymezen\u00e9ho dohodou (\u00a7 76). Dle \u00a7 78 lze poskytnout p\u0159\u00edsp\u011bvek na podporu zam\u011bstn\u00e1v\u00e1n\u00ed osob se zdravotn\u00edm posti\u017een\u00edm na chr\u00e1n\u011bn\u00e9m pracovn\u00edm m\u00edst\u011b (\u00a7 78 odst. 1,2), a to rozhodnut\u00edm (\u00a7 78 odst. 8), jemu\u017e mus\u00ed p\u0159edch\u00e1zet uzav\u0159en\u00ed dohody s \u00fa\u0159adem pr\u00e1ce o vymezen\u00ed chr\u00e1n\u011bn\u00e9ho pracovn\u00edho m\u00edsta.<\/div>\n<div><\/div>\n<div><strong>Z definice chr\u00e1n\u011bn\u00e9ho pracovn\u00edho m\u00edsta<\/strong> obsa\u017een\u00e9 v \u00a7 75 odst. 1 z\u00e1kona o zam\u011bstnanosti plyne, \u017ee jde o pracovn\u00ed m\u00edsto z\u0159\u00edzen\u00e9<\/div>\n<div>zam\u011bstnavatelem pro osobu se zdravotn\u00edm posti\u017een\u00edm na z\u00e1klad\u011b p\u00edsemn\u00e9 dohody s \u00da\u0159adem pr\u00e1ce, p\u0159i\u010dem\u017e chr\u00e1n\u011bn\u00fdm pracovn\u00edm m\u00edstem m\u016f\u017ee b\u00fdt i pracovn\u00ed m\u00edsto, kter\u00e9 je obsazeno osobou se zdravotn\u00edm posti\u017een\u00edm, pokud je vymezeno v p\u00edsemn\u00e9 dohod\u011b mezi zam\u011bstnavatelem a \u00da\u0159adem pr\u00e1ce.<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Pra\u017esk\u00e1 firma EUC Premium Assistance s.r.o. p\u0159i zm\u011bn\u00e1ch v administrativ\u011b chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst (CHPM) v roce 2012 p\u0159i\u0161la o \u010dtvrt milionu korun.
