Nyn\u00ed mi v\u0161ak zam\u011bstnavatel ozn\u00e1mil, \u017ee pokud si nevy\u0159\u00edd\u00edm ID, budu propu\u0161t\u011bna. ID jsem nedostala, ale dostala jsem v\u00fdpov\u011b\u010f, kterou jsem je\u0161t\u011b nepodepsala. M\u00e1 zam\u011bstnavatel pr\u00e1vo m\u011b propustit a zam\u011bstnat m\u00edsto m\u011b invalidu, proto\u017ee na n\u011bj bere vy\u0161\u0161\u00ed podporu? A nejsem sama, OZZ se firma zbavuje u\u017e rok. Ne\u0161kod\u00ed takov\u00e1 soci\u00e1ln\u00ed politika lidem s OZZ? Hled\u00e1m si novou pr\u00e1ci od doby, kdy m\u011b zam\u011bstnavatel upozornil na propu\u0161t\u011bn\u00ed, ale s OZZ m\u011b necht\u011bj\u00ed, maj\u00ed obavu, \u017ee pr\u00e1ci nebudu zvl\u00e1dat a budu \u010dasto marodit. Co m\u00e1m, pros\u00edm, d\u011blat?<\/strong><\/p>\n<p><!--more--><\/p>\n<p><em>ilustra\u010dn\u00ed foto: Rochelle \/ Flickr<\/em><\/p>\n<p><strong>Odpov\u011b\u010f<\/strong>:<\/p>\n<p>Zam\u011bstnavatel m\u00e1 pr\u00e1vo propustit zam\u011bstnance, nebo\u0165 neexistuje pr\u00e1vn\u00ed p\u0159edpis, kter\u00fd by zam\u011bstnavateli zakazoval kohokoli za standardn\u00edch okolnost\u00ed propustit ze zam\u011bstn\u00e1n\u00ed.<\/p>\n<p class=\"DocumentAnnotation\">Ov\u0161em existuj\u00ed ale ur\u010dit\u00e9 v\u00fdjimky, ur\u010dit\u00e9 soci\u00e1ln\u00ed, zdravotn\u00ed nebo jin\u00e9 situace, v n\u00ed\u017e se zam\u011bstnanec nach\u00e1z\u00ed, a kdy je zam\u011bstnanec v \u201cochrann\u00e9 dob\u011b\u201c.<\/p>\n<div class=\"clear\">\u00a0<strong>Kdy nelze zam\u011bstnance propustit<\/strong><\/div>\n<div class=\"DocumentBody\">\n<div id=\"WYSIWYGContentBody\">\n<p>Zejm\u00e9na se jedn\u00e1 o zdravotn\u00ed stav zam\u011bstnance (nap\u0159. do\u010dasn\u00e1 pracovn\u00ed neschopnost), ztr\u00e1ta zdravotn\u00edch nebo jin\u00fdch p\u0159edpoklad\u016f k pr\u00e1ci v no\u010dn\u00ed dob\u011b, t\u011bhotenstv\u00ed nebo jin\u00e9 p\u0159ek\u00e1\u017eky v pr\u00e1ci (nap\u0159. mate\u0159sk\u00e1 nebo rodi\u010dovsk\u00e1 dovolen\u00e1) apod. Z\u00e1kon\u00edk pr\u00e1ce (ZP) zakazuje zam\u011bstnavateli, aby mohl v t\u011bchto nebo dal\u0161\u00edch p\u0159\u00edpadech d\u00e1t zam\u011bstnanci v\u00fdpov\u011b\u010f. V\u00fd\u010det t\u011bchto d\u016fvod\u016f je uveden v \u00a7 53 ZP.<\/p>\n<div><\/div>\n<div>Zam\u011bstnavatel nem\u016f\u017ee d\u00e1t zam\u011bstnanci v\u00fdpov\u011b\u010f:<\/div>\n<div>\n<ul>\n<li>v dob\u011b, kdy<b> je uzn\u00e1n do\u010dasn\u011b neschopn\u00fdm pr\u00e1ce<\/b>, pokud si tuto neschopnost \u00famysln\u011b nep\u0159ivodil nebo nevznikla \u2013li tato neschopnost jako bezprost\u0159edn\u00ed n\u00e1sledek opilosti zam\u011bstnance nebo zneu\u017eit\u00ed n\u00e1vykov\u00fdch l\u00e1tek, a v dob\u011b od pod\u00e1n\u00ed n\u00e1vrhu na \u00fastavn\u00ed o\u0161et\u0159ov\u00e1n\u00ed nebo od n\u00e1stupu l\u00e1ze\u0148sk\u00e9ho l\u00e9\u010den\u00ed a\u017e do dne jejich ukon\u010den\u00ed (p\u0159i onemocn\u011bn\u00ed tuberkul\u00f3zou se tato ochrann\u00e1 doba prodlu\u017euje o 6 m\u011bs\u00edc\u016f po propu\u0161t\u011bn\u00ed z \u00fastavn\u00edho o\u0161et\u0159ov\u00e1n\u00ed),<\/li>\n<li>p\u0159i v\u00fdkonu<b> vojensk\u00e9ho cvi\u010den\u00ed nebo v\u00fdjime\u010dn\u00e9ho vojensk\u00e9ho cvi\u010den\u00ed <\/b>ode dne, kdy byl zam\u011bstnanci doru\u010den povol\u00e1vac\u00ed rozkaz, po dobu v\u00fdkonu t\u011bchto cvi\u010den\u00ed, a\u017e do uplynut\u00ed 2 t\u00fddn\u016f po jeho propu\u0161t\u011bn\u00ed z t\u011bchto cvi\u010den\u00ed,<\/li>\n<li>v dob\u011b, kdy je zam\u011bstnanec dlouhodob\u011b pln\u011b<b> uvoln\u011bn pro v\u00fdkon ve\u0159ejn\u00e9 funkce<\/b>,<\/li>\n<li>v dob\u011b, kdy je zam\u011bstnankyn\u011b <b>t\u011bhotn\u00e1 <\/b>nebo kdy zam\u011bstnankyn\u011b \u010derp\u00e1 <b>mate\u0159skou dovolenou<\/b> nebo kdy zam\u011bstnankyn\u011b nebo zam\u011bstnanec\u00a0 \u010derpaj\u00ed <b>rodi\u010dovskou dovolenou<\/b>,<\/li>\n<li>v dob\u011b, kdy je zam\u011bstnanec, kter\u00fd pracuje v noci, uzn\u00e1n na z\u00e1klad\u011b l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho za\u0159\u00edzen\u00edm z\u00e1vodn\u00ed preventivn\u00ed p\u00e9\u010de do\u010dasn\u011b <b>nezp\u016fsobil\u00fdm pro no\u010dn\u00ed pr\u00e1ci<\/b>.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div><\/div>\n<p><strong>Podm\u00ednky, kter\u00e9 si zam\u011bstnavatel sjednal s \u00fa\u0159adem pr\u00e1ce p\u0159i z\u0159\u00edzen\u00ed pracovn\u00edho m\u00edsta pro OZZ<\/strong><br \/>\nOt\u00e1zkou je, s jak\u00fdmi charakteristikami z\u0159\u00eddil zam\u011bstnavatel chr\u00e1n\u011bn\u00e9 pracovn\u00ed m\u00edsto pro osobu zdravotn\u011b znev\u00fdhodn\u011bnou (OZZ), p\u0159i\u010dem\u017e na toto z\u0159\u00edzen\u00ed z\u00edskal p\u0159\u00edsp\u011bvek od \u00fa\u0159adu pr\u00e1ce. V sou\u010dasn\u00e9 dob\u011b je sice kategorie chr\u00e1n\u011bn\u00fdch pracovn\u00edch m\u00edst zru\u0161ena, nicm\u00e9n\u011b podm\u00ednky, za kter\u00fdch bylo pracovn\u00ed m\u00edsto z\u0159\u00edzeno, je t\u0159eba z pohledu \u00fa\u0159adu pr\u00e1ce nad\u00e1le dodr\u017eovat. Pokud bylo pracovn\u00ed m\u00edsto z\u0159\u00edzeno v\u00fdhradn\u011b pro OZZ, nem\u011blo by b\u00fdt mo\u017en\u00e9 na takov\u00e9m pracovn\u00edm m\u00edst\u011b zam\u011bstnat invalidn\u00edho ob\u010dana. Pokud tedy bylo pracovn\u00ed m\u00edsto, na kter\u00e9m pracujete z\u0159\u00edzeno pro OZZ, konzultoval bych tuto situaci s pracovn\u00edky krajsk\u00e9 pobo\u010dky \u00fa\u0159adu pr\u00e1ce, kte\u0159\u00ed se zam\u011bstnavatelem sjedn\u00e1vali dohodu o z\u0159\u00edzen\u00ed tohoto pracovn\u00edho m\u00edsta. Rovn\u011b\u017e by nem\u011blo b\u00fdt mo\u017en\u00e9 p\u0159ij\u00edmat do zam\u011bstn\u00e1n\u00ed invalidy a p\u0159itom m\u00edt voln\u00e1 neobsazen\u00e1 pracovn\u00ed m\u00edsta pro OZZ, p\u0159esto\u017ee tito o zam\u011bstn\u00e1n\u00ed \u017e\u00e1daj\u00ed.<br \/>\nTakov\u00e1 soci\u00e1ln\u00ed politika lidem s ZZ samoz\u0159ejm\u011b, jak p\u00ed\u0161ete, \u0161kod\u00ed. Uv\u00e1d\u00edte p\u0159itom, \u017ee v\u00e1s jin\u00ed zam\u011bstnavatel\u00e9 kv\u016fli ZZ necht\u011bj\u00ed zam\u011bstnat. Lze doporu\u010dit, abyste va\u0161i obt\u00ed\u017enou situaci ozn\u00e1mila na Ministerstvu pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed, nebo\u0165 tento vrcholn\u00fd org\u00e1n st\u00e1tn\u00ed moci ur\u010duje podm\u00ednky podpory zam\u011bstn\u00e1v\u00e1n\u00ed invalid\u016f a OZZ a jejich schv\u00e1len\u00ed ve form\u011b novelizace z\u00e1konn\u00fdch p\u0159edpis\u016f prosazuje na p\u016fd\u011b parlamentu. Bez p\u0159\u00edslu\u0161n\u00fdch podn\u011bt\u016f toti\u017e MPSV danou soci\u00e1ln\u00ed politiku, na kterou si st\u011b\u017eujete, m\u011bnit nebude. D\u00e1le je mo\u017en\u00e9 se obr\u00e1tit i na m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00e9ho poslance, kter\u00fd se soci\u00e1ln\u00ed problematikou zab\u00fdv\u00e1.<\/p>\n<p>V neposledn\u00ed \u0159ad\u011b tak\u00e9 m\u016f\u017ee m\u00edt v\u00fdznam, jak\u00fd d\u016fvod pro va\u0161e propu\u0161t\u011bn\u00ed zam\u011bstnavatel ve sv\u00e9 v\u00fdpov\u011bdi uvedl.
