Nyn\u00ed mi byl odebr\u00e1n. Po\u017e\u00e1dal jsem si tedy o OZZ a zam\u011bstnavatel mi ozn\u00e1mil, \u017ee m\u011b u\u017e jako osobu s OZZ nezam\u011bstn\u00e1, \u017ee jsem pozbyl status osoby ID.  Kde je tedy pravda? M\u00e1 \u00a0na takov\u00e9 jedn\u00e1n\u00ed \u00a0pr\u00e1vo? <\/strong><\/p>\n\n\n\n<p><strong>Odpov\u011b\u010f<\/strong>:<\/p>\n\n\n\n<p>Zam\u011bstnavatel m\u00e1 pr\u00e1vo propustit zam\u011bstnance pouze z d\u016fvod\u016f stanoven\u00fdch z\u00e1kon\u00edkem pr\u00e1ce. Pokud tedy nesouhlas\u00edte s ukon\u010den\u00edm  pracovn\u00edho pom\u011bru a zam\u011bstnavatel trv\u00e1 na tomto ukon\u010den\u00ed, pak zam\u011bstnavateli nezb\u00fdv\u00e1, ne\u017e d\u00e1t zam\u011bstnanci v\u00fdpov\u011b\u010f jako jednostrann\u00fd pr\u00e1vn\u00ed akt. V\u00fdpov\u011b\u010f mus\u00ed b\u00fdt p\u00edsemn\u00e1 a mus\u00ed obsahovat d\u016fvod k ukon\u010den\u00ed pracovn\u00edho pom\u011bru. <br><br>Zlep\u0161en\u00ed zdravotn\u00edho stavu zam\u011bstnance, kdy zam\u011bstnanec nap\u0159. ji\u017e nen\u00ed invalidn\u00edm, ale st\u00e1v\u00e1 se &#8222;jen&#8220; osobou se zdravotn\u00edm znev\u00fdhodn\u011bn\u00edm, nem\u016f\u017ee b\u00fdt d\u016fvodem k v\u00fdpov\u011bdi zam\u011bstnance. D\u016fvodem k v\u00fdpov\u011bdi mohou b\u00fdt nap\u0159. organiza\u010dn\u00ed zm\u011bny, poru\u0161ov\u00e1n\u00ed pracovn\u00edch povinnost\u00ed, poru\u0161ov\u00e1n\u00ed pracovn\u00ed k\u00e1zn\u011b,  neuspokojiv\u00e9 pracovn\u00ed v\u00fdsledky, zdravotn\u00ed nezp\u016fsobilost apod. V\u00fdpov\u011b\u010f mus\u00ed b\u00fdt v\u017edy p\u00edsemn\u00e1 a mus\u00ed b\u00fdt v n\u00ed d\u016fvody uvedeny.   <\/p>\n\n\n\n<p><strong>Jak\u00e9 jsou d\u016fvody, pro kter\u00e9 m\u016f\u017ee zam\u011bstnavatel d\u00e1t v\u00fdpov\u011b\u010f? <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a) ru\u0161\u00ed-li se zam\u011bstnavatel nebo jeho \u010d\u00e1st,<\/li><li>b) p\u0159em\u00eds\u0165uje-li se zam\u011bstnavatel nebo jeho \u010d\u00e1st,<\/li><li>c) stane-li se zam\u011bstnanec nadbyte\u010dn\u00fdm, proto\u017ee se rozhodlo o zm\u011bn\u011b jeho \u00fakol\u016f, technick\u00e9ho vybaven\u00ed, nebo o sn\u00ed\u017een\u00ed stavu zam\u011bstnanc\u016f (kv\u016fli zv\u00fd\u0161en\u00ed efektivnosti pr\u00e1ce, nebo o jin\u00fdch organiza\u010dn\u00edch zm\u011bn\u00e1ch,<\/li><li>d) nesm\u00ed-li zam\u011bstnanec podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho pracovn\u00edm l\u00e9ka\u0159em d\u00e1le konat dosavadn\u00ed pr\u00e1ci pro pracovn\u00ed \u00faraz, onemocn\u011bn\u00ed nemoc\u00ed z povol\u00e1n\u00ed nebo pro ohro\u017een\u00ed touto nemoc\u00ed..,<\/li><li>e) pozbyl-li zam\u011bstnanec vzhledem ke sv\u00e9mu zdravotn\u00edmu stavu podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho pracovn\u00edm l\u00e9ka\u0159em, dlouhodob\u011b zdravotn\u00ed zp\u016fsobilost,<\/li><li>f) nespl\u0148uje-li zam\u011bstnanec p\u0159edpoklady stanoven\u00e9 pr\u00e1vn\u00edmi p\u0159edpisy pro v\u00fdkon sjednan\u00e9 pr\u00e1ce nebo nespl\u0148uje-li bez zavin\u011bn\u00ed zam\u011bstnavatele po\u017eadavky pro \u0159\u00e1dn\u00fd v\u00fdkon t\u00e9to pr\u00e1ce; spo\u010d\u00edv\u00e1-li nespl\u0148ov\u00e1n\u00ed t\u011bchto po\u017eadavk\u016f v neuspokojiv\u00fdch pracovn\u00edch v\u00fdsledc\u00edch, je mo\u017en\u00e9 zam\u011bstnanci z tohoto d\u016fvodu d\u00e1t v\u00fdpov\u011b\u010f, jen jestli\u017ee byl zam\u011bstnavatelem v dob\u011b posledn\u00edch 12 m\u011bs\u00edc\u016f p\u00edsemn\u011b vyzv\u00e1n k jejich odstran\u011bn\u00ed a zam\u011bstnanec je v p\u0159im\u011b\u0159en\u00e9 dob\u011b neodstranil,<\/li><li>g) jsou-li u zam\u011bstnance d\u00e1ny d\u016fvody, pro kter\u00e9 by s n\u00edm zam\u011bstnavatel mohl okam\u017eit\u011b zru\u0161it pracovn\u00ed pom\u011br, nebo pro z\u00e1va\u017en\u00e9 poru\u0161en\u00ed povinnosti vypl\u00fdvaj\u00edc\u00ed z pr\u00e1vn\u00edch p\u0159edpis\u016f vztahuj\u00edc\u00edch se k zam\u011bstnancem vykon\u00e1van\u00e9 pr\u00e1ci; pro soustavn\u00e9 m\u00e9n\u011b z\u00e1va\u017en\u00e9 poru\u0161ov\u00e1n\u00ed povinnosti vypl\u00fdvaj\u00edc\u00ed z pr\u00e1vn\u00edch p\u0159edpis\u016f vztahuj\u00edc\u00edch se k vykon\u00e1van\u00e9 pr\u00e1ci je mo\u017en\u00e9 d\u00e1t zam\u011bstnanci v\u00fdpov\u011b\u010f, jestli\u017ee byl v dob\u011b posledn\u00edch 6 m\u011bs\u00edc\u016f v souvislosti s poru\u0161en\u00edm povinnosti vypl\u00fdvaj\u00edc\u00ed z pr\u00e1vn\u00edch p\u0159edpis\u016f vztahuj\u00edc\u00edch se k vykon\u00e1van\u00e9 pr\u00e1ci p\u00edsemn\u011b upozorn\u011bn na mo\u017enost v\u00fdpov\u011bdi,<\/li><li>h) poru\u0161\u00ed-li zam\u011bstnanec zvl\u00e1\u0161\u0165 hrub\u00fdm zp\u016fsobem jinou povinnost zam\u011bstnance stanovenou v <a href=\"https:\/\/www.pracomat.cz\/poradna\/zakonik-prace\/179-zakonik-prace-cast-13-hlava-2.html\">\u00a7 301a<\/a>.<\/li><\/ul>\n\n\n\n<p>Ov\u0161em existuj\u00ed tak\u00e9 ur\u010dit\u00e9 v\u00fdjimky, ur\u010dit\u00e9 soci\u00e1ln\u00ed, zdravotn\u00ed nebo jin\u00e9 situace, v n\u00ed\u017e se zam\u011bstnanec nach\u00e1z\u00ed, a kdy je zam\u011bstnanec v \u201cochrann\u00e9 dob\u011b\u201c a nen\u00ed mo\u017en\u00e9 mu d\u00e1t v\u00fdpov\u011b\u010f..<\/p>\n\n\n\n<p><strong>Kdy nelze zam\u011bstnance propustit<\/strong><\/p>\n\n\n\n<p>Zejm\u00e9na se jedn\u00e1 o zdravotn\u00ed stav zam\u011bstnance (nap\u0159. do\u010dasn\u00e1 pracovn\u00ed neschopnost), ztr\u00e1ta zdravotn\u00edch nebo jin\u00fdch p\u0159edpoklad\u016f k pr\u00e1ci v no\u010dn\u00ed dob\u011b, t\u011bhotenstv\u00ed nebo jin\u00e9 p\u0159ek\u00e1\u017eky v pr\u00e1ci (nap\u0159. mate\u0159sk\u00e1 nebo rodi\u010dovsk\u00e1 dovolen\u00e1) apod. Z\u00e1kon\u00edk pr\u00e1ce (ZP) zakazuje zam\u011bstnavateli, aby mohl v t\u011bchto nebo dal\u0161\u00edch p\u0159\u00edpadech d\u00e1t zam\u011bstnanci v\u00fdpov\u011b\u010f. V\u00fd\u010det t\u011bchto d\u016fvod\u016f je uveden v \u00a7 53 ZP.\n\nZam\u011bstnavatel nem\u016f\u017ee d\u00e1t zam\u011bstnanci v\u00fdpov\u011b\u010f:\n\n<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>v dob\u011b, kdy<strong> je uzn\u00e1n do\u010dasn\u011b neschopn\u00fdm pr\u00e1ce<\/strong>, pokud si tuto neschopnost \u00famysln\u011b nep\u0159ivodil nebo nevznikla \u2013li tato neschopnost jako bezprost\u0159edn\u00ed n\u00e1sledek opilosti zam\u011bstnance nebo zneu\u017eit\u00ed n\u00e1vykov\u00fdch l\u00e1tek, a v dob\u011b od pod\u00e1n\u00ed n\u00e1vrhu na \u00fastavn\u00ed o\u0161et\u0159ov\u00e1n\u00ed nebo od n\u00e1stupu l\u00e1ze\u0148sk\u00e9ho l\u00e9\u010den\u00ed a\u017e do dne jejich ukon\u010den\u00ed (p\u0159i onemocn\u011bn\u00ed tuberkul\u00f3zou se tato ochrann\u00e1 doba prodlu\u017euje o 6 m\u011bs\u00edc\u016f po propu\u0161t\u011bn\u00ed z \u00fastavn\u00edho o\u0161et\u0159ov\u00e1n\u00ed),<\/li><li>p\u0159i v\u00fdkonu<strong> vojensk\u00e9ho cvi\u010den\u00ed nebo v\u00fdjime\u010dn\u00e9ho vojensk\u00e9ho cvi\u010den\u00ed <\/strong>ode dne, kdy byl zam\u011bstnanci doru\u010den povol\u00e1vac\u00ed rozkaz, po dobu v\u00fdkonu t\u011bchto cvi\u010den\u00ed, a\u017e do uplynut\u00ed 2 t\u00fddn\u016f po jeho propu\u0161t\u011bn\u00ed z t\u011bchto cvi\u010den\u00ed,<\/li><li>v dob\u011b, kdy je zam\u011bstnanec dlouhodob\u011b pln\u011b<strong> uvoln\u011bn pro v\u00fdkon ve\u0159ejn\u00e9 funkce<\/strong>,<\/li><li>v dob\u011b, kdy je zam\u011bstnankyn\u011b <strong>t\u011bhotn\u00e1 <\/strong>nebo kdy zam\u011bstnankyn\u011b \u010derp\u00e1 <strong>mate\u0159skou dovolenou<\/strong> nebo kdy zam\u011bstnankyn\u011b nebo zam\u011bstnanec&nbsp; \u010derpaj\u00ed <strong>rodi\u010dovskou dovolenou<\/strong>,<\/li><li>v dob\u011b, kdy je zam\u011bstnanec, kter\u00fd pracuje v noci, uzn\u00e1n na z\u00e1klad\u011b l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho za\u0159\u00edzen\u00edm z\u00e1vodn\u00ed preventivn\u00ed p\u00e9\u010de do\u010dasn\u011b <strong>nezp\u016fsobil\u00fdm pro no\u010dn\u00ed pr\u00e1ci<\/strong>.<\/li><li> <\/li><\/ul>\n\n\n\n<p>P\u0159i nekorektn\u00edm od\u016fvodn\u011bn\u00ed v\u00fdpov\u011bdi (nap\u0159\u00edklad kdyby zam\u011bstnavatel uvedl pr\u00e1v\u011b d\u016fvod, kter\u00fd zmi\u0148ujete) \u2013 m\u016f\u017ee b\u00fdt v\u00fdpov\u011b\u010f neplatn\u00e1. <\/p>\n\n\n\n<p>Ov\u0161em zam\u011bstnavatel m\u016f\u017ee z\u00edskat v\u00e1\u0161 souhlas s ukon\u010den\u00edm pracovn\u00edho pom\u011bru a tedy m\u016f\u017ee se s v\u00e1mi na odchodu ze zam\u011bstn\u00e1n\u00ed dohodnout spolu s odstupn\u00fdm. Tato <strong>dohoda o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru<\/strong> mus\u00ed b\u00fdt op\u011bt p\u00edsemn\u00e1, jinak nebude platn\u00e1. Nemus\u00ed ji\u017e ale obsahovat d\u016fvody pro ukon\u010den\u00ed pracovn\u00edho pom\u011bru, nebo\u0165 je projevem souhlasn\u00e9 v\u016fle jak zam\u011bstnavatele, tak i zam\u011bstnance. Pokud se v\u0161ak oba na uveden\u00ed d\u016fvodu v t\u00e9to p\u00edsemn\u00e9 dohod\u011b o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru dohodnou, m\u016f\u017ee b\u00fdt tento d\u016fvod v dohod\u011b uveden.   <\/p>\n\n\n\n<p>redakce invArena<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>DOTAZ: Pob\u00edral jsem ID 1. stupn\u011b.
