P\u0159ed n\u011bkolika lety jsem si na\u0161el pr\u00e1ci na krat\u0161\u00ed \u00favazek. Po roce zam\u011bstn\u00e1n\u00ed mi byl pracovn\u00ed pom\u011br prodlou\u017een na dobu neur\u010ditou. Jeliko\u017e ve firm\u011b, kde pracuji, koluj\u00ed drby o propou\u0161t\u011bn\u00ed, m\u00e1m obavu, \u017ee jako invalidn\u00ed d\u016fchodce budu prvn\u00ed na \u0159ad\u011b a dostanu v\u00fdpov\u011b\u010f. Zaj\u00edmalo by m\u011b, zda bych i v p\u0159\u00edpad\u011b, \u017ee jsem invalidn\u00ed d\u016fchodce, m\u011bl n\u00e1rok na odstupn\u00e9.   <br><br>Odpov\u011b\u010f: P\u00ed\u0161ete, \u017ee sou\u010dasn\u011b pob\u00edr\u00e1te invalidn\u00ed d\u016fchod a mzdu. Jste zam\u011bstn\u00e1n na z\u00e1klad\u011b pracovn\u00ed smlouvy, a to na dobu neur\u010ditou. Pro posouzen\u00ed n\u00e1roku na odstupn\u00e9 nen\u00ed podstatn\u00e9 to, zda je zam\u011bstnanec v pracovn\u00edm pom\u011bru sou\u010dasn\u011b uzn\u00e1n invalidn\u00edm a pob\u00edr\u00e1 d\u016fchod. N\u00e1rok na odstupn\u00e9 se odv\u00edj\u00ed od zp\u016fsobu a d\u016fvodu ukon\u010den\u00ed pracovn\u00edho pom\u011bru. Problematiku odstupn\u00e9ho upravuje ustanoven\u00ed \u00a7 67 z\u00e1kona \u010d. 262\/2006 Sb., Z\u00e1kon\u00edku pr\u00e1ce. N\u00e1rok na odstupn\u00e9 m\u00e1 mimo jin\u00e9 zam\u011bstnanec, u n\u011bho\u017e doch\u00e1z\u00ed k ukon\u010den\u00ed pracovn\u00edho pom\u011bru v\u00fdpov\u011bd\u00ed danou zam\u011bstnavatelem z takzvan\u00fdch organiza\u010dn\u00edch d\u016fvod\u016f. Mezi tyto d\u016fvody pat\u0159\u00ed z\u00e1nik zam\u011bstnavatele nebo jeho \u010d\u00e1sti, p\u0159em\u00edst\u011bn\u00ed zam\u011bstnavatele nebo jeho \u010d\u00e1sti a nadbyte\u010dnost zam\u011bstnance. Odstupn\u00e9 n\u00e1le\u017e\u00ed i v p\u0159\u00edpad\u011b, \u017ee dojde k ukon\u010den\u00ed pracovn\u00edho pom\u011bru dohodou zam\u011bstnance a zam\u011bstnavatele z n\u011bkter\u00e9ho z uveden\u00fdch d\u016fvod\u016f. V t\u011bchto p\u0159\u00edpadech tak vznik\u00e1 n\u00e1rok na odstupn\u00e9 ze z\u00e1kona. V\u00fd\u0161e odstupn\u00e9ho se pak odv\u00edj\u00ed od d\u00e9lky trv\u00e1n\u00ed pracovn\u00edho pom\u011bru. Pokud pracovn\u00ed pom\u011br trval m\u00e9n\u011b ne\u017e jeden rok, m\u00e1 zam\u011bstnanec n\u00e1rok na odstupn\u00e9 ve v\u00fd\u0161i jednoho pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku, jestli\u017ee pracovn\u00ed pom\u011br trval jeden a\u017e dva roky, \u010din\u00ed odstupn\u00e9 dvojn\u00e1sobek pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku. Pokud pracovn\u00ed pom\u011br trval nejm\u00e9n\u011b dva roky, pak p\u0159\u00edslu\u0161\u00ed odstupn\u00e9 ve v\u00fd\u0161i trojn\u00e1sobku pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku. Je mo\u017en\u00e9, aby odstupn\u00e9 bylo na z\u00e1klad\u011b rozhodnut\u00ed zam\u011bstnavatele i vy\u0161\u0161\u00ed, nem\u016f\u017ee v\u0161ak b\u00fdt ni\u017e\u0161\u00ed. Odstupn\u00e9 d\u00e1le m\u016f\u017ee zam\u011bstnavatel p\u0159iznat i v jin\u00fdch p\u0159\u00edpadech ukon\u010den\u00ed pracovn\u00edho pom\u011bru, to je v\u0161ak ji\u017e jen na jeho rozhodnut\u00ed. V\u00e1\u0161 p\u0159\u00edpadn\u00fd n\u00e1rok na odstupn\u00e9 by se tak odv\u00edjel od toho, jak\u00fdm zp\u016fsobem a z jak\u00e9ho d\u016fvodu by p\u0159\u00edpadn\u011b do\u0161lo k ukon\u010den\u00ed pracovn\u00edho pom\u011bru.
