P\u0159ibl\u00ed\u017e\u00edme tak\u00e9 n\u00e1lez \u00dastavn\u00edho soudu, kter\u00fd se zab\u00fdv\u00e1 nutnost\u00ed strp\u011bt v ur\u010dit\u00fdch p\u0159\u00edpadech vy\u0161\u0161\u00ed m\u00edru kritiky ne\u017e ostatn\u00ed.&nbsp;<\/p>\n\n\n\n<p>Jak by se mohla zv\u00fd\u0161it prosperita v na\u0161\u00ed zemi? Expertn\u00ed poradci \u010desk\u00e9 vl\u00e1dy p\u0159i\u0161li s \u0159e\u0161en\u00edm zd\u00e1nliv\u011b paradoxn\u00edm. Jedn\u00edm z d\u00edl\u010d\u00edch recept\u016f by podle nich mohlo b\u00fdt omezen\u00ed pr\u00e1v zam\u011bstnanc\u016f. Inspiraci m\u00e1 tato cesta v d\u00e1nsk\u00e9m modelu Flexicurity, kter\u00fd se v D\u00e1nsku jev\u00ed b\u00fdt funk\u010dn\u00ed a efektn\u00ed. V \u010dem spo\u010d\u00edv\u00e1 a jak by jej bylo mo\u017en\u00e9 aplikovat na \u010desk\u00e9 pom\u011bry?<\/p>\n\n\n\n<p>D\u00e1nsk\u00fd trh pr\u00e1ce je charakteristick\u00fd flexibilitou zahrnuj\u00edc\u00ed n\u00edzkou m\u00edru ochrany zam\u011bstnanc\u016f p\u0159ed propu\u0161t\u011bn\u00edm, ale s vysok\u00fdmi d\u00e1vkami v nezam\u011bstnanosti a efektivn\u00edm syst\u00e9mem soci\u00e1ln\u00edho zabezpe\u010den\u00ed. D\u016fraz je kladen na tripartitn\u00ed spolupr\u00e1ci mezi odbory, zam\u011bstnavateli a st\u00e1tem, s vysok\u00fdm stupn\u011bm organizovanosti obou skupin. Je zde b\u011b\u017en\u00e1 vysok\u00e1 mobilita pracovn\u00ed s\u00edly a d\u016fle\u017eit\u00e1 je tak\u00e9 takzvan\u00e1 funk\u010dn\u00ed flexibilita zam\u011bstnanc\u016f.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zmena\">Jak a pro\u010d zm\u011bnit \u010desk\u00fd z\u00e1kon\u00edk pr\u00e1ce<\/h2>\n\n\n\n<p>V nov\u00e9m n\u00e1vrhu N\u00e1rodn\u00ed ekonomick\u00e9 rady vl\u00e1dy (NERV) pro modernizaci \u010desk\u00e9ho pracovn\u00edho pr\u00e1va se objevuj\u00ed kl\u00ed\u010dov\u00e9 reformy inspirovan\u00e9 pr\u00e1v\u011b d\u00e1nsk\u00fdm modelem.&nbsp;<strong>Hlavn\u00edm bodem je zjednodu\u0161en\u00ed procesu propou\u0161t\u011bn\u00ed.<\/strong>&nbsp;NERV navrhuje, aby&nbsp;<strong>zam\u011bstnavatel\u00e9 mohli propustit zam\u011bstnance bez nutnosti uv\u00e1d\u011bt konkr\u00e9tn\u00ed d\u016fvod<\/strong>. To by v\u0161ak bylo kompenzov\u00e1no odstupn\u00fdm, jeho\u017e v\u00fd\u0161e by se odv\u00edjela od d\u00e9lky pracovn\u00edho pom\u011bru, podobn\u011b jako je tomu dnes. Dal\u0161\u00edm n\u00e1vrhem je prodlou\u017een\u00ed&nbsp;<a href=\"https:\/\/dostupnyadvokat.cz\/blog\/vypoved-ve-zkusebni-dobe\">zku\u0161ebn\u00ed doby<\/a>, co\u017e by m\u011blo zam\u011bstnavatel\u016fm umo\u017enit l\u00e9pe posoudit vhodnost zam\u011bstnance pro danou pozici.<\/p>\n\n\n\n<p>Tato navrhovan\u00e1 zm\u011bna m\u00e1 reflektovat pot\u0159ebu flexibiln\u011bj\u0161\u00edho trhu pr\u00e1ce v \u010cesk\u00e9 republice. O\u010dek\u00e1v\u00e1 se, \u017ee uvoln\u011bn\u00ed podm\u00ednek pro propou\u0161t\u011bn\u00ed povede k dynamick\u00e9mu pracovn\u00edmu trhu, kde budou zam\u011bstnavatel\u00e9 schopni rychleji reagovat na m\u011bn\u00edc\u00ed se ekonomick\u00e9 podm\u00ednky a pot\u0159eby firmy. Tento p\u0159\u00edstup v\u0161ak vy\u017eaduje rovnov\u00e1hu, aby byla zaji\u0161t\u011bna ochrana zam\u011bstnanc\u016f, co\u017e je v\u00fdzva, kterou\u00a0<a href=\"https:\/\/vlada.gov.cz\/cz\/ppov\/nerv_2020\/narodni-ekonomicka-rada-vlady-182438\/\" target=\"_blank\" rel=\"noreferrer noopener\">NERV<\/a>\u00a0adresuje prost\u0159ednictv\u00edm n\u00e1vrh\u016f na odstupn\u00e9 a podporu p\u0159i p\u0159echodu na nov\u00e9 pracovn\u00ed pozice.<\/p>\n\n\n\n<p>Navrhovan\u00e1 reforma by m\u011bla rovn\u011b\u017e stimulovat zam\u011bstnavatele k investic\u00edm do rozvoje a \u0161kolen\u00ed sv\u00fdch pracovn\u00edk\u016f, co\u017e je zp\u016fsob, jak sn\u00ed\u017eit rizika spojen\u00e1 s potenci\u00e1ln\u00edm propou\u0161t\u011bn\u00edm a z\u00e1rove\u0148 podpo\u0159it profesn\u00ed r\u016fst zam\u011bstnanc\u016f.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"nepruzne\">Je \u010desk\u00e9 pracovn\u00ed pr\u00e1vo nepru\u017en\u00e9?<\/h2>\n\n\n\n<p>Pro \u010desk\u00e9ho zam\u011bstnance, zvykl\u00e9ho po desetilet\u00ed na enormn\u00ed pr\u00e1vn\u00ed ochranu, kdy drtiv\u00e1 v\u011bt\u0161ina lid\u00ed v podstat\u011b \u201cnevyhoditeln\u00e1\u201d, se m\u016f\u017ee jednat na prvn\u00ed pohled o opat\u0159en\u00ed velmi tvrd\u00e9. Je ale t\u0159eba se na problematiku pod\u00edvat komplexn\u011b a prakticky. Zd\u00e1n\u00ed toti\u017e klame.<\/p>\n\n\n\n<p>Sou\u010dasn\u00fd \u010desk\u00fd&nbsp;<a href=\"https:\/\/dostupnyadvokat.cz\/blog\/zakonik-prace\">z\u00e1kon\u00edk pr\u00e1ce<\/a>&nbsp;p\u0159edstavuje pro zam\u011bstnavatele i schopn\u00e9 zam\u011bstnance ur\u010dit\u00e9 nev\u00fdhody, zejm\u00e9na v kontextu v\u00fdpov\u011bdn\u00edch podm\u00ednek. Striktn\u00ed regulace propou\u0161t\u011bn\u00ed m\u016f\u017ee v\u00e9st k zna\u010dn\u00e9 rigidit\u011b na trhu pr\u00e1ce.&nbsp;<strong>Zam\u011bstnavatel\u00e9 \u010dasto \u010del\u00ed komplikovan\u00e9mu procesu p\u0159i rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru, co\u017e m\u016f\u017ee omezovat jejich flexibilitu<\/strong>&nbsp;v rychle se m\u011bn\u00edc\u00edm ekonomick\u00e9m prost\u0159ed\u00ed. Tato rigidita m\u016f\u017ee paradoxn\u011b tak\u00e9 odrazovat firmy od p\u0159ij\u00edm\u00e1n\u00ed nov\u00fdch zam\u011bstnanc\u016f, jeliko\u017e se ob\u00e1vaj\u00ed mo\u017en\u00fdch komplikac\u00ed p\u0159i pot\u0159eb\u011b budouc\u00edho propou\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<p>Probl\u00e9m v\u0161ak je v tom, \u017ee takto to funguje na pap\u00ed\u0159e. Z na\u0161\u00ed praxe v\u00edme, \u017ee stejn\u011b z\u00e1kon\u00edk pr\u00e1ce zam\u011bstnance nakonec neochr\u00e1n\u00ed, resp. ke skon\u010den\u00ed praocvn\u00edho pom\u011bru dojde. Je to v\u0161ak nespravedliv\u00e9. Kdo se nebr\u00e1n\u00ed, ke \u201codejit\u201d bez \u0159\u00e1dn\u00e9ho odstupn\u00e9ho (n\u011bkdy se dokonce dohody o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru protipr\u00e1vn\u011b podepisuj\u00ed hned p\u0159i n\u00e1stupu jen bez uveden\u00ed dne podpisu). Naopak, kdy\u017e se zam\u011bstnanec br\u00e1n\u00ed, m\u016f\u017ee z\u00edskat vysok\u00e9 odstupn\u00e9. Zam\u011bstnavatele to v\u0161ak stoj\u00ed mnoho pen\u011bz i na pr\u00e1vn\u00ed pomoc.<\/p>\n\n\n\n<p>Nejeden zam\u011bstnanec \u010di zam\u011bstnankyn\u011b se pak tak\u00e9 setkali s t\u00edm, \u017ee vykon\u00e1vaj\u00ed \u00fakoly i za ostatn\u00ed kolegy, proto\u017ee \u201coni to zvl\u00e1dnou\u201d, kde\u017eto kapacity a schopnosti jejich koleg\u016f a kolegy\u0148 jsou omezen\u00e9.&nbsp;<strong>Na pracovi\u0161t\u00edch tak mnohdy existuje skupina lid\u00ed, kter\u00e1 dny tr\u00e1v\u00ed surfov\u00e1n\u00edm na s\u00edti a komentov\u00e1n\u00edm posledn\u00edho d\u00edlu obl\u00edben\u00e9ho seri\u00e1lu, zat\u00edmco ostatn\u00ed spolupracovn\u00edci d\u011blaj\u00ed ve\u0161kerou pr\u00e1ci.<\/strong>&nbsp;I pro tyto posledn\u011b jmenovan\u00e9 by flexibilita propou\u0161t\u011bn\u00ed znamenala velkou \u00falevu.<\/p>\n\n\n\n<p>Zam\u011bstnanci sice maj\u00ed vysokou m\u00edru form\u00e1ln\u00ed ochrany, ale t\u00edm, \u017ee je obecn\u011b na trhu pr\u00e1ce ni\u017e\u0161\u00ed mobilita,&nbsp;<strong>brzd\u00ed to i ty, kte\u0159\u00ed by v\u00fdpov\u011b\u010f bez probl\u00e9m\u016f d\u00e1t mohli<\/strong>&nbsp;(zam\u011bstnanci u n\u00e1s p\u0159i pod\u00e1n\u00ed v\u00fdpov\u011bdi nejsou v\u00e1z\u00e1ni \u017e\u00e1dn\u00fdmi d\u016fvody). Tato situace tak m\u016f\u017ee v\u00e9st k men\u0161\u00ed motivaci zam\u011bstnanc\u016f ke zm\u011bn\u011b pracovn\u00ed pozice nebo k dal\u0161\u00edmu profesn\u00edmu rozvoji.<\/p>\n\n\n\n<p>V\u00fd\u0161e uveden\u00e9 pak souvis\u00ed i s dopadem na celkovou ekonomiku.&nbsp;<strong>P\u0159\u00edli\u0161n\u00e1 ochrana zam\u011bstnanc\u016f m\u016f\u017ee v\u00e9st k men\u0161\u00ed dynamice a inovativnosti v podnik\u00e1n\u00ed<\/strong>, co\u017e m\u016f\u017ee m\u00edt dlouhodob\u011b negativn\u00ed dopad na hospod\u00e1\u0159sk\u00fd r\u016fst a konkurenceschopnost zem\u011b.<\/p>\n\n\n\n<p>Takto se aktu\u00e1ln\u00ed podoba \u010desk\u00e9ho&nbsp;<a href=\"https:\/\/dostupnyadvokat.cz\/blog\/zakonik-prace\">z\u00e1kon\u00edku pr\u00e1ce<\/a>&nbsp;m\u016f\u017ee st\u00e1t bari\u00e9rou nejen pro zam\u011bstnavatele, ale i pro samotn\u00e9 zam\u011bstnance a celou ekonomiku, kter\u00e1 pot\u0159ebuje v\u00edce flexibiln\u00ed a adaptabiln\u00ed trh pr\u00e1ce.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dansky\">V \u010dem spo\u010d\u00edv\u00e1 d\u00e1nsk\u00fd model a jak\u00e9 jsou jeho v\u00fdhody?<\/h2>\n\n\n\n<p>D\u00e1nsk\u00fd model, zn\u00e1m\u00fd tak\u00e9 jako \u201eflexicurity\u201c, je charakterizov\u00e1n svou flexibiln\u00ed pracovn\u00ed politikou, kter\u00e1 kombinuje snadn\u00e9 propou\u0161t\u011bn\u00ed zam\u011bstnanc\u016f s vysokou m\u00edrou soci\u00e1ln\u00ed ochrany a aktivn\u00ed politikou zam\u011bstnanosti. Tento&nbsp;<strong>model umo\u017e\u0148uje zam\u011bstnavatel\u016fm snadno m\u011bnit sv\u00e9 pracovn\u00ed s\u00edly<\/strong>&nbsp;v reakci na ekonomick\u00e9 zm\u011bny.&nbsp;<strong>Nevytv\u00e1\u0159\u00ed ale ze zam\u011bstnanc\u016f ustra\u0161en\u00e9 bytosti<\/strong>, kter\u00e9 se ka\u017ed\u00fd den boj\u00ed o svou pracovn\u00ed pozici. Zaji\u0161\u0165uje jim toti\u017e sou\u010dasn\u011b siln\u00e9 soci\u00e1ln\u00ed jistoty a podporu p\u0159i hled\u00e1n\u00ed nov\u00e9ho zam\u011bstn\u00e1n\u00ed. To zahrnuje i \u0161t\u011bdr\u00e9 soci\u00e1ln\u00ed d\u00e1vky a aktivn\u00ed opat\u0159en\u00ed na podporu zam\u011bstnanosti, jako jsou&nbsp;<strong>rekvalifika\u010dn\u00ed kurzy a poradenstv\u00ed<\/strong>. Flexibilita trhu pr\u00e1ce napom\u00e1h\u00e1 inovac\u00edm a konkurenceschopnosti, zat\u00edmco siln\u00e9 soci\u00e1ln\u00ed zabezpe\u010den\u00ed a podpora zam\u011bstnanc\u016f p\u0159i zm\u011bn\u011b pr\u00e1ce p\u0159isp\u00edv\u00e1 k ekonomick\u00e9 a soci\u00e1ln\u00ed stabilit\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"vyhody\">Jak\u00e9 v\u00fdhody i nev\u00fdhody lze od aplikace d\u00e1nsk\u00e9ho modelu do na\u0161ich pom\u011br\u016f o\u010dek\u00e1vat?<\/h2>\n\n\n\n<p>Porovn\u00e1n\u00edm ne\u0161var\u016f sou\u010dasn\u00e9ho \u010desk\u00e9ho trhu a v\u00fdhod trhu d\u00e1nsk\u00e9ho m\u016f\u017eeme dosp\u011bt k my\u0161lence, \u017ee transformace \u010desk\u00e9ho pracovn\u00edho pr\u00e1va nast\u00edn\u011bn\u00fdm sm\u011brem by mohla \u010cesk\u00e9 republice p\u0159in\u00e9st \u0159adu v\u00fdhod. Pro zam\u011bstnance by tento model znamenal v\u011bt\u0161\u00ed mobilitu a mo\u017enost rychlej\u0161\u00ed zm\u011bny zam\u011bstn\u00e1n\u00ed, co\u017e by mohlo v\u00e9st k lep\u0161\u00edmu vyhled\u00e1v\u00e1n\u00ed pracovn\u00edch p\u0159\u00edle\u017eitost\u00ed.<\/p>\n\n\n\n<p>Odstranilo by to i v\u00fd\u0161e uveden\u00e9 administrativn\u00ed n\u00e1klady (t\u0159eba i na n\u00e1s pr\u00e1vn\u00edky).<\/p>\n\n\n\n<p>Na druhou stranu, existuj\u00ed tak\u00e9 potenci\u00e1ln\u00ed nev\u00fdhody.&nbsp;<strong>Zv\u00fd\u0161en\u00e1 flexibilita na trhu pr\u00e1ce m\u016f\u017ee v\u00e9st k men\u0161\u00ed pracovn\u00ed jistot\u011b<\/strong>, co\u017e by mohlo b\u00fdt stresuj\u00edc\u00ed pro n\u011bkter\u00e9 zam\u011bstnance.&nbsp;<strong>Rovn\u011b\u017e by bylo nezbytn\u011b nutn\u00e9 pos\u00edlit soci\u00e1ln\u00ed syst\u00e9m a zabezpe\u010dit adekv\u00e1tn\u00ed podporu pro ty, kte\u0159\u00ed p\u0159ijdou o pr\u00e1ci, co\u017e by mohlo vy\u017eadovat v\u00fdznamn\u00e9 investice<\/strong>&nbsp;a reorganizaci st\u00e1vaj\u00edc\u00edch soci\u00e1ln\u00edch slu\u017eeb.
